(“alexa360”, “Owner”, “we”, or “us”) provides an online software platform that allows developers, individuals, companies and agencies (the “Customers”) to build, manage and host chatbots. These Terms of Service (these “Terms”) shall govern the use of alexa360 (“alexa360”, “The Application”, “Service”).

By clicking on the “I Agree” button, registering for an account, downloading the App, using the Services, or participating in any interaction facilitated by the Services, you acknowledge and agree to be bound by these Terms of Service. If you do not agree, you must refrain from accessing or using the Services.

This Agreement applies to all users of the Services, including, without limitation, browsers, vendors, customers, merchants, content contributors, business owners, and agencies.

1. Our Services

alexa360 provides a platform for creating and deploying automated chat flows across various messaging services, social media platforms, and other third-party integrations.

By accessing or purchasing our Services, you agree to abide by this Agreement. In cases where a separate written agreement governs your use of the Services, that agreement will take precedence if conflicts arise.

2. Account, Password, and Security

To access the Services, you must register and create an account (“Account”). You agree to:

  • Provide accurate, complete, and current information during registration.
  • Maintain the confidentiality of your login credentials.
  • Accept full responsibility for all activities under your account.

If you suspect unauthorized account use or a security breach, you must notify alexa360 immediately at [email protected]

3. Agencies and Business Owners

  1. Business Owners: Individuals or entities that use alexa360 to market, support, or develop their business.
  2. Agencies: Third-party service providers managing alexa360 accounts on behalf of Business Owners.

Agencies must:

  1. Identify Business Owners as administrators on the relevant accounts.
  2. Ensure compliance with all alexa360 policies.

Business Owners retain ultimate responsibility for the account and payments.

4. User-Generated Content

User-generated content includes all materials uploaded, submitted, or shared through alexa360. You are solely responsible for ensuring:

  • Content is accurate and lawful.
  • It does not infringe on third-party rights.
  • It complies with alexa360 content guidelines.

alexa360 reserves the right to remove content that violates these terms.

 

5. Communication by Text Message or Email

By using alexa360, you consent to receiving messages, reminders, and notifications via email or SMS for the purposes of:

  • Service improvements.
  • Account updates.
  • Marketing communications (with consent).

You may opt out of communications by emailing [email protected] or managing your settings.

6. Prohibited Uses

Users may not use the Services for unlawful activities, harassment, spamming, or violating third-party rights. Examples of prohibited activities include, but are not limited to:

  • Uploading malicious code.
  • Transmitting unsolicited messages.
  • Interfering with platform operations.

Violations may result in account suspension or termination.

7. Billing and Payment

All subscription plans, usage-based fees, and payment terms are outlined on our website (https://alexa360.io). Payments are processed via a third-party payment provider.

Refund Policy: Refunds will be issued in compliance with Kuwait Consumer Law.

8. Termination and Suspension

We may terminate or suspend your account for any reason, including violation of these Terms. Upon termination:

  • Your account access will be revoked.
  • alexa360 reserves the right to delete all associated data.

9. Ownership and Intellectual Property Rights

All intellectual property rights associated with alexa360, including trademarks, copyrights, and proprietary software, remain the exclusive property of alexa360.

Users retain ownership of content they create but grant alexa360 a license to host and process it as part of the Services.

10. Indemnification

You agree to indemnify alexa360 and its affiliates from claims or liabilities arising from:

  • Your use of the Services.
  • Breach of these Terms.
  • Violations of applicable laws or regulations.

11. Dispute Resolution

Governing Law: These Terms are governed by the laws of Kuwait.

Dispute Process: In the event of a dispute, users agree to resolve issues through mediation before initiating legal action.

12. Changes to the Agreement

alexa360 reserves the right to update these Terms of Service at any time. Significant changes will be communicated via email or platform notifications. Continued use of the Services constitutes acceptance of the updated terms.

13. Notices and Consent to Receive Notices

You consent to receive all communications, including updates to these Terms, electronically.

1. خدماتنا

تُوفر Alexa360 منصةً لإنشاء ونشر تدفقات دردشة آلية عبر مختلف خدمات المراسلة، ومنصات التواصل الاجتماعي، وغيرها من عمليات التكامل مع جهات خارجية.


باستخدامك خدماتنا أو شرائها، فإنك تُوافق على الالتزام بهذه الاتفاقية. في حال وجود اتفاقية مكتوبة منفصلة تُنظّم استخدامك للخدمات، تُعتد بهذه الاتفاقية في حال نشوء أي تعارض.

2. الحساب، كلمة المرور، والأمان

للوصول إلى الخدمات، يجب عليك التسجيل وإنشاء حساب ("الحساب"). أنت توافق على:

• تقديم معلومات دقيقة وكاملة وحديثة أثناء التسجيل.

• الحفاظ على سرية بيانات تسجيل الدخول الخاصة بك.

• تحمّل المسؤولية الكاملة عن جميع الأنشطة التي تتم عبر حسابك.

• في حال الشك في استخدام غير مصرح به للحساب أو حدوث خرق أمني، يجب عليك إخطار alexa360 فورًا عبر البريد الإلكتروني [email protected]


3. الوكالات وأصحاب الأعمال


أ. أصحاب الأعمال: الأفراد أو الكيانات التي تستخدم alexa360 لتسويق أعمالها أو دعمها أو تطويرها.


ب. الوكالات: مقدمو خدمات تابعون لجهات خارجية يديرون حسابات alexa360 نيابةً عن أصحاب الأعمال.


يجب على الوكالات:

1. تحديد أصحاب الأعمال كمسؤولين عن الحسابات ذات الصلة.

2. ضمان الامتثال لجميع سياسات alexa360.


يتحمل أصحاب الأعمال المسؤولية الكاملة عن الحساب والمدفوعات.


4. المحتوى الذي ينشئه المستخدم


يشمل المحتوى الذي ينشئه المستخدم جميع المواد التي يتم تحميلها أو إرسالها أو مشاركتها عبر alexa360. أنت وحدك المسؤول عن ضمان:

• دقة المحتوى وقانونيته.

• عدم انتهاكه لحقوق الأطراف الثالثة.

• الامتثال لإرشادات محتوى alexa360.


تحتفظ alexa360 بالحق في إزالة المحتوى الذي ينتهك هذه الشروط.


5. التواصل عبر الرسائل النصية أو البريد الإلكتروني

باستخدامك alexa360، فإنك توافق على تلقي الرسائل والتذكيرات والإشعارات عبر البريد الإلكتروني أو الرسائل النصية القصيرة لأغراض:

• تحسين الخدمة.

• تحديثات الحساب.

• الاتصالات التسويقية (بموافقتك).


يمكنك إلغاء الاشتراك في الاتصالات عن طريق مراسلة [email protected] أو إدارة إعداداتك.


6. الاستخدامات المحظورة


لا يجوز للمستخدمين استخدام الخدمات في أنشطة غير قانونية، أو مضايقات، أو إرسال رسائل غير مرغوب فيها، أو انتهاك حقوق الأطراف الثالثة. تشمل أمثلة الأنشطة المحظورة، على سبيل المثال لا الحصر:

• تحميل برمجيات خبيثة.

• إرسال رسائل غير مرغوب فيها.

• التدخل في عمليات المنصة.

قد تؤدي المخالفات إلى تعليق الحساب أو إنهائه.


7. الفوترة والدفع

جميع خطط الاشتراك، والرسوم المرتبطة بالاستخدام، وشروط الدفع موضحة على موقعنا الإلكتروني (https://alexa360.io). تتم معالجة المدفوعات عبر جهة خارجية مزودة لخدمات الدفع.


سياسة الاسترداد: سيتم إصدار المبالغ المستردة وفقًا لقانون حماية المستهلك الكويتي.


8. الإنهاء والتعليق

يجوز لنا إنهاء حسابك أو تعليقه لأي سبب، بما في ذلك انتهاك هذه الشروط. عند الإنهاء:

• سيتم إلغاء وصولك إلى حسابك.

• تحتفظ alexa360 بالحق في حذف جميع البيانات المرتبطة.

يمكنك إلغاء حسابك عن طريق التواصل معنا عبر البريد الإلكتروني [email protected]


9. حقوق الملكية الفكرية

جميع حقوق الملكية الفكرية المرتبطة بـ alexa360، بما في ذلك العلامات التجارية وحقوق النشر والبرامج الاحتكارية، تظل ملكية حصرية لـ alexa360.

يحتفظ المستخدمون بملكية المحتوى الذي ينشئونه، لكنهم يمنحون alexa360 ترخيصًا لاستضافته ومعالجته كجزء من الخدمات.


10. التعويض

أنت توافق على تعويض alexa360 والشركات التابعة لها عن أي مطالبات أو التزامات ناشئة عن:

• استخدامك للخدمات.

• خرق هذه الشروط.

• مخالفات القوانين أو اللوائح المعمول بها.


11. حل النزاعات

القانون الحاكم: تخضع هذه الشروط لقوانين دولة الكويت.


إجراءات حل النزاعات: في حالة نشوء نزاع، يوافق المستخدمون على حل المشكلات من خلال الوساطة قبل الشروع في أي إجراء قانوني.


12. تعديلات الاتفاقية

تحتفظ alexa360 بالحق في تحديث شروط هذه الاتفاقية.
